NJDEP REAL Program: What It Means for Flood Risk, Development & Your Property

NJDEP’s NEW REAL Rules: A Major Shift in Flood Elevation Standards Across New Jersey

The New Jersey Department of Environmental Protection (NJDEP) is implementing a major regulatory reform called REAL — Resilient Environments and Landscapes — designed to modernize how the state manages flood risk, coastal development, and climate resilience. These changes represent the most significant update to New Jersey’s flood hazard rules in decades and will impact how homes and buildings are designed, permitted, and constructed in flood-prone areas.

 

What is the REAL Program?

The REAL program is part of NJ’s broader NJ Protecting Against Climate Threats (NJPACT) initiative to update environmental and land use regulations to reflect projected sea-level rise, more frequent extreme weather, and future flooding conditions that are not captured in current standards.

Unlike existing flood rules based on historical data, REAL seeks to anticipate future conditions by integrating climate science into development and floodplain management.

 

Key Change: New Flood Elevation Standard

One of the most impactful aspects of the REAL reforms is a new flood elevation requirement in coastal and tidal areas:

  • NJDEP is proposing that regulatory flood elevations for new or substantially improved buildings be based on **FEMA’s Base Flood Elevation (100-year flood level) **plus 4 feet[*] of climate-adjusted height.
  • This replaces the original proposal for a 5-foot addition and reflects updated sea level rise projections.

This change will likely expand regulated flood zones, meaning more properties could fall within a flood hazard area and be subject to higher design and construction standards.

(Footnote): While the elevation standard has been reduced from 5 feet to 4 feet based on updated climate data, the final number will be set in the adopted rules.

Implementation Timeline & Grace Period

The NJDEP published a Notice of Substantial Change to the REAL rules in July 2025, triggering a second public comment period and additional hearings before final adoption.

Once adopted — anticipated late 2025 or early 2026 — the rules will include a 180-day grandfathering period. This gives property owners and developers time to file complete applications under the current regulations before the new standards begin to apply.

2024 Housing Market Predictions

Several important factors are impacting the real estate markets all over the country, even here in Lavallette, Ortley Beach, Seaside Park, and South Seaside Park. We here on the barrier island -- from South Seaside Park to Seaside Park and Seaside Heights, Otelry Beach, Lavallette, up through Mantoloking, Bay Head and Point Pleasant Beach, Manasquan, and Spring Lake -- are not immune to these factors.
